Charter of the Intellectual Property Law Alliance of Guangdong- Hong Kong-Macao Greater Bay Area IPLAG

Chapter 1 General Principles

Article 1  The Alliance is named 粵港澳大灣區知識產權法律聯盟in Chinese,hereafter referred to as 聯盟) andThe Intellectual Property Law Alliance of Guangdong-Hong Kong-Macao Greater Bay Area in English (hereafter referred to as IPLAG)

Article 2  The Alliance aims to act in response of the national strategy of development of the Great Bay Area, unite the forces of law schools of colleges and universities, legal service agencies and other associations, build an intellectual property think tank, move forward intellectual property cooperation, and promote the standards of intellectual property legal services in the Greater Bay Area.

Article 3  Initiated by the Faculty of Law/ Macau Intellectual Property Research Center of MUST( the key research base of Humanity and Social Science by the Ministry of Education) and co-founded by the Law School/Intellectual Property School of Jinan University and Faculty of Law of the University of Hong Kong, the IPLAG shall accept membership applications from colleges and universities, legal service agencies and other social groups in the Greater Bay Area.

Article 4  The IPLAG must abide by the laws and regulations of Chinese mainland, Macao S.A.R and Hong Kong S.A.R..

 

Chapter 2 the Executive Committee

Article 5  The Executive Committee is the supreme organ of the IPLAG, it shall be responsible for formulating and amending charter of the IPLAG, the development plan and work plan, reviewing the membership application and other major matters.

Article 6  The Executive Committee shall be recommended by all IPLAG members and shall comprise a President and two Vice Presidents. The Presidents shall be the representative recommended by the Faculty of Law/Macau Intellectual Property Research Center of MUST and the Vice Presidents shall be the representatives from initiating units. The terms of office for both the president and the vice presidents shall be two years and renewable. Each IPLAG member shall recommend a representative to be Committee member.

Article 7  The Executive Committee meets at least once a year. The President shall also convoke an interim meeting if necessary. Decisions shall be adopted by the affirmative vote of half of the members attending the meeting.

Article 8  The Secretariat shall be set up in Macau Intellectual Property Research Center  and led by the Committee. A Secretary-General shall be appointed and responsible for connecting with IPLAG members and dealing with daily affairs. The working rules shall be set out by the Committee.

Article 9  The operating expenses and other expenses will be shared by all IPLAG members and fiscal budget plan will be discussed and made by the Committee.


Chapter 3 Cooperation

Article 10  The IPLAG cooperation includes intellectual property talents training, academic research and social service, e tc.

Article 11  The members can represent the IPLAG to organize activities to external bodies with the approval of the Committee. 


Chapter 4 Rights and Obligations

Article 12  The IPLAG members shall enjoy the following rights:

12.1 Participating the activities and events of the Alliance;

12.2 Making suggestions and proposals for work of the Alliance;

12.3 Supervising work of the Allance;

12.4 Other reasonable rights in accordance with the Charter.

Article 13  The IPLAG members shall fulfil the following obligations:

13.1 Observing the Charter and maintaining the legitimate rights of the Alliance;

13.3 Actively implementing the resolutions of the Executive Committee;

13.3 Sincerely cooperating with the Secretariat and taking on other matters


Chapter 5 Membership

Article 14  All new applicants shall be invited or recommended by the Committee members of IPLAG and approved by the Committee.

Article 15  Any members may withdraw from the Alliance.

The Executive Committee may terminate the membership of any members from the Alliance in accordance with the voting rules in the event that a member fails to carry out any of its obligations under this charter.

 

Chapter 6 Supplemental Provisions

Article 16  This charter shall be adopted by the Executive Committee and enter into force after being publicized to all members. All IPLAG members shall abide by the charter equally.

Article 17  All outstanding issues or amendments shall be supplemented or amended by the Secretariat and come into effect after being reviewed and approved by the Committee.

Article 18  The Executive Committee shall reserve the power to interpret the present charter.
