The forum was moderated by Prof. Yi Zaicheng, Assistant Dean of the Faculty of Law.
During the keynote session, Mr. Lu Chunwei provided a systematic overview of the development of the commercial arbitration system in Mainland China, introduced the practical application of arbitration in resolving intellectual property disputes, analyzed both the advantages and challenges of arbitration in handling foreign-related disputes, and shared SHAC’s efforts in strengthening coordination between litigation and arbitration through collaboration with the Shanghai Third Intermediate People's Court to promote a diversified dispute resolution mechanism.
Drawing on extensive practical experience, Ms. Lou Xianying examined the underlying logic of resolving foreign-related intellectual property disputes. She emphasized that, amid rapid advancements in artificial intelligence and shifts in the international competitive landscape, intellectual property protection systems require restructuring. Legal professionals should cultivate a global perspective and strategic mindset to better serve both business objectives and national security interests.
Dr. Liao Si focused on procedural regulation of cross-border evidence gathering in foreign-related intellectual property cases. He analyzed the practical challenges, normative foundations, and institutional obstacles associated with cross-border evidence collection, and proposed recommendations for improving evidence-taking mechanisms at both the international and domestic levels, as well as enhancing legal professionals’ capabilities in response to emerging challenges in the AI era.
Ms. Zhang Junqin introduced the service framework of the WIPO Arbitration and Mediation Center, noting that litigation alone may not always provide the most effective solution for intellectual property disputes. WIPO offers alternative dispute resolution services, including arbitration, mediation, and expert determination, which are particularly advantageous in cross-border intellectual property disputes due to their confidentiality and efficiency.
The presentations combined theoretical depth with practical insights, featuring rich case studies and detailed analysis that provided valuable academic and professional perspectives for participating faculty members, students, and legal practitioners. As commentator for the forum, Ms. Liu Yuxin offered insightful observations and professional reflections based on her own practice experience.
The signing of these cooperation agreements marks a new milestone in the development of the Faculty of Law. As one of the Faculty’s signature academic platforms, the Cross-Strait Legal Forum will continue to bring together expertise from academia and practice, leverage Macau’s unique role in the Guangdong-Hong Kong-Macao Greater Bay Area, and contribute to the cultivation of high-caliber professionals in foreign-related rule of law.
